Below we have described some tips for Buyers and Sellers. Please consult an Associate if you wish assistance or when not experienced with contract handling.
Seller Tips:
The system is built in a way that you can easily describe your yacht in detailed, prefabricated specification. It is our experience that this detailed information enables buyers to make easier choices.
Always be clear and exact as possible in describing your yacht, as incorrect information might effect disappointed buyers, incurring extra costs. Correct information saves you and clients from wasting time.

If you or your own representative are not able to show your yacht yourselves to clients we advise you to contact a YachtsClub Associate for such assistance.
Once you have found a buyer for your yacht, we advise you to have some assistance of professionals or a YachtsClub Associate who can work out a detailed contract etc. The YachtsClub Associates can offer modular contract assistance at competitive tariffs. See also the advises under Buyer tips that inform in general so that you already can collect the documents that are often required. In cases where a buyer only wishes to make a decision after a sea trial, that takes longer than several hours, it may be reasonable that you should both agree that the buyer pays a reasonable fee as usual for a charter, should the buyer decide not to buy the yacht. Should the sea trial result in a sale, this charter fee could be deducted from the purchase sum.
In general we advise to agree conditions and price in writing on forehand under condition of "satisfactory seatrial and survey".

Buyers Tips:
The system is built in a way that you can easily find the yachts of your preference.
The Yachts Watcher aid even informs you, automatically by e-mail should a yacht enter the system that matches your search request, saving you valuable time. After a period of 6 months you will need to re-activate your Yachts Watcher entry.
The system will alert you when your subscription to this service expires.

In case you wish to buy a yacht we advise the following steps in logical order:
- require from the seller an option (free of obligations) before you start travelling, to avoid that a yacht is sold meanwhile.
- inspect the yacht and have, if possible, a short sea trial to see if the yacht basically meets your expectations.
- if you wish to proceed it is time to discuss price and conditions, but only agree to such when correctly described in a contract (Memorandum of Agreement).
- we advise that especially for the larger yachts a Memorandum of Agreement should consist the following most important items:
- Sale is subject to survey and sea trial to test and ensure that apart from eventually defects that have been described in the yacht specifications, the yacht has no other major defects.
- If other defects have been found seller should agree to have such repaired for his account, or in case that defects represent over 10% of the sales-sum, or do not allow you to have use of the yacht before a sudden date you have the right to withdraw without further obligations.
- In case of a survey you should always hire an experienced and independent surveyor, see addresses in Info Centre >.
- Pay attention to the details! You must receive duly signed copies of Proof of Ownership of the seller, as well as a notary legalised Bill of Sale and if the yacht is registered in an official ship register, a deletion certificate of registration. This last item enables you to register the yacht in your name. Further we advise you to acquire an official certificate of VAT payment if the yacht is sold as VAT Paid status.
- Purchase sum payment is to be described detailed in the MoA, by Letter of Credit or irrevocable Bank Guarantee, or eventually to be deposited with an escrow agent if he has a third part account and which purchase sum is only payable at the same time you receive the yacht in the condition as agreed (together with the relevant documents, brochures and manuals if available). For this a Protocol of Delivery & Acceptance should be agreed upon, signed by the buyer the moment of hand-over to the seller, in which the document irrevocably instructs the bank or escrow agent to pay the purchase sum to the seller.
- A proper MoA further describes many other specific details.
- Remember to have the yacht insured from the moment of completing the purchase.
In the past, many yachts have been sold by hand-shake. Occasionally that worked out well, but often it ended up in court. To avoid discussions and to show a seller that you are a serious buyer, a proper MoA is a must. Although we understand that still many buyers & sellers hate paperwork a MoA clearly describes the rights and duties of both parties and avoids or minimizes trouble afterwards. As we say in Holland good agreements make good friends.
In case you only wish to decide to purchase the yacht after you have made a sea trial (that may take longer than several hours) it may be reasonable that you are required to pay a reasonable fee as usual for a charter. In case this results in a purchase of the yacht this charter fee could be deducted from the purchase sum.
